I.Protection scope of IPR Customs Recordation

The trademark rights, patent rights and copyrights which are approved by the state government departments are all within the protection scope of IPR Customs Recordation.

 

II.Content and Functions of IPR Customs Recordation Certificate

A recordation certificate states IP Recordation No., right holder, the Recorded IP name, expiration date and so on. It can be used when filing an application for protective measures to port Customs or when filing an application for change to the General Administration of Customs of China.

 

III.Validity of IPR Customs Recordation

In accordance with the relevant Law and Regulations, a recordation becomeseffective since the date of issuing the registration certificate by the General Administration of Customs of China. It is valid for 7 years. Trademark right is valid for 10 years, renewable for expiration. Patent right is valid for 20 years, utility model and design patents are valid for 10 years. Copyright is valid for 50 years of life and death.

 

As filing an Application for IPR Customs Recordation, the following documentsshall be submitted:

1.A copy of Certificate of Incorporation with the seal of Administration for Industry & Commerce;

2.A copy of Entitlement Certificate such as trademark registration certificate, patent,and copyright registration certificate ; and

3.Power of Attorney
